| Tartalmi kivonat: | The creation of intellectual property based on research and development cooperation between universities and industry its legal instrument are primarily contracts. The law names two type of contracts on the field of these co-operations, the research contract and the license agreement. The aim of research and effective co-operation is to ensure the proper results of research and licensing. The importance of these contracts is not negligible. Because of the special field of the law and the characteristic of these contracts they don’t get enough attention from the legislator area and not even from the legal literature. The research contract wasn’t governed by the Act IV of 1959 on the Civil Code but the modification of the Act in 1977 a multi-level regulation came in force. The current provisions of the 2013 Civil Code made a significant and different picture of the research contract and from the outcome of the research. The license agreement still not governed by the Code even though it is one of the most important contract of the commercial life and the cornerstone of the technology transfer. Near these two types of contracts I will briefly show two other types of contracts. One is the non-disclosure agreement (NDA) the other is the material transfer agreement (MTA). After these I will show what are the advantages and disadvantages of a these cooperations for a higher education institution. |
