| Tartalmi kivonat: | The Canadian society is a very special independent model and this consideration relates to the state organization and the legal system as well. In my work I should like to underpin this by presenting some characteristic features of the Canadian legal system, the structure of the judiciary and the process of the appointment of judges. Canada is a legal pluralistic state. Besides the civil and the common law systems the indigenous legal traditions are also incorporated. There is a special interdependence between the pluralistic legal system and the federalism. Canada's historical and constitutional development have shown that diversity can be reconciled with unity. The judicial system is well-structured, reflects the federalitic arrangement of the country and the high-level specialization of courts. The court system is very flexible and functions efficiently. A multifaceted institutional network implements the training of judges. These programs especially focus on the social and psychological peculiarities of the work of judges. The independence of the court, the impartial and fair procedure are the basic principles of the functioning of the Canadian judiciary. Nevertheless, the decisive position of the federal and provincial govemments in the process of the appointment of judges generates critical remarks. |
