| Tartalmi kivonat: | In my study, I have examined whether there is a safeguard reason linked to the extension of the scope of the review by the office in the review procedure which serves as a justification for limiting the division of functions. In doing so, I first explored the conceptual framework that determines the scope of the review and whether the extension of the power of review plays a guaranteeing role. I then examined the case-law of the Curia on the grounds for ex officio review and attempted to answer the question whether, in addition to doctrine, case-law experience justifies a rule. |
